Property Division

Most divorces have three major areas—children’s issues, support issues, and property division. 

In some respects, property division can be relatively straight forward, as the basic goal is to divide the marital estate equally.  The marital estate encompasses all of both parties’ assets and debts.  This includes, but is not limited to, houses, land, retirements, cash and investment accounts, vehicles, business interests and personal property.  However, there are nuances to property division that can make this issue complicated for some people.  

If someone had premarital assets or debts, those circumstances could impact the division of the estate.  If either party received an inheritance or gift, or is the beneficiary of a trust, those facts might also change the analysis.  Issues such as the valuation of business interests or pensions, marital waste, electronic currency, and hidden assets can make property division difficult and may require the assistance of financial experts.
