Modification

After a divorce is final or you finalize a custody and parenting time arrangement, it may be necessary to change some of the terms.  While property division terms cannot be modified, other terms can be modified. 

  • Legal Custody - Legal custody of the children can be modified if there is a substantial change of circumstances and it is in the children’s best interests to change legal custody. 

  • Parenting Plan - A parenting plan can be modified if it is in the children’s best interests to do so. 

  • Child Support - Child support may be modified if there is a substantial change in any of the factors that go into calculating the support, such as either party’s income, childcare costs, or health insurance costs. 

  • Spousal Support - The amount or duration of spousal support can be modified, or the responsibility terminated, if there is a substantial unanticipated change in circumstances that impacts a party’s income or expenses.
